Court reserved judgement in the legal battle
between People's National Party candidate Phyllis Mitchell and Jamaica Labour
Party (JLP) Member of Parliament (MP) for North East St. Catherine, Gregory
Mair.Judgement was reserved by the three member panel on February 18th. Ms Mitchell, who is seeking to unseat Mr. Mair, had appealed against a Supreme Court ruling handed down in favour of Mr. Mair in November last year. The Supreme Court had ruled that the JLP MP was not properly served with the election petition filed by Ms Mitchell. Mr. Mair contended that he was in Parliament when he was served with the petition. His lawyers had argued that, under the law, civil processes cannot be served in Parliament and Senior Puisne Judge Marva McIntosh upheld the submissions. But Ms Mitchell contends that the election petition was also sent by registered mail to an address in the Mr. Mair's constituency. She had filed a petition contending that he had Venezuelan citizenship and was not entitled, under the Constitution, to be elected as an MP. |
